9. Limitation of Liability

Elite Logistics shall not be liable for:

• Delays caused by weather, traffic, road conditions, or other circumstances beyond our control
• Loss or damage due to improper packing by the customer
• Consequential, indirect, or special damages
• Loss of profits, business, or anticipated savings
• Damage to goods not declared or misdeclared at the time of booking

Our liability for any claim shall not exceed the transportation charges paid for the specific shipment in question.

10. Insurance

We strongly recommend that customers obtain comprehensive transit insurance for their cargo. While we exercise utmost care in handling your goods, insurance provides additional protection against unforeseen events.

Insurance coverage arranged by Elite Logistics is subject to the terms and conditions of the insurance policy. Claims must be filed within the timeframe specified in the policy.

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

12. Indemnification

You agree to indemnify and hold harmless Elite Logistics, its directors, employees, agents, and subcontractors from and against any claims, damages, losses, costs, and expenses (including legal fees) arising from:

• Your breach of these terms and conditions
• Your violation of any applicable law
• Any misrepresentation by you regarding the cargo
• Your negligence or willful misconduct

13. Termination

We reserve the right to terminate or suspend our services if:

• You breach any of these terms and conditions
• You provide false or misleading information
• You fail to make payments as agreed
• Continuing service would violate any law or regulation
• You engage in conduct that is harmful to our business or reputation

14. Dispute Resolution

Any disputes arising from or relating to these terms or our services shall first be attempted to be resolved through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

The arbitration shall be conducted in Mumbai, Maharashtra, and the language of arbitration shall be English.

15. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts in Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes.
